Directors present: Scot Karr, Anita Greenwald, John Bernson, Beata Buhl Tatka, and Colin McBride.

 

Met via Zoom at 10:00 am. Guests present: Robert Ferrara, President of FMG (“FMG”), Michael Leonard (FMG)

 

  1. Approval of Board meeting minutes
    • The minutes of the August 16 meeting were approved with no changes.

 

  1. Financial Report by Controller  
    • Cash Balances: John Bernson, Treasurer, reported that the cash balances are in good condition.
    • Payables: Payables are current. 
    • Arrears Report: No arrears.
    • Operating revenue and expenses are on target.
    • Budget 2023
    • Scot and John shared the 2023 proposed budget which they said was balanced, but may be subject to change.
    • Roof assessment should end by June 2023 which will allow monthly maintenance to be reduced to$ 915 in after a mulching project is completed in2023.
    • Calautti Landscaping fees will increase slightly in 2023.
    • At present it appears roads can be repaired without the need for a loan.
    • The Budget is approved and will be sent out with the Notice of Annual Meeting.

 

  1. Unit Owner/ Resident Issues
  2. 2 Alder Way (Sacchetti) Re: Front Stoop
     - Final approval is needed from the town

 

  1. Open Items
  2. Tree Removal & Replacement – 80-90 trees removed.  Stump removal and replanting next.
  3. Deck Replacement – need to select decks to be replaced based on a structural needs basis.

 

Annual Meeting set for October 12, 2022.

  1. Approval of Board meeting minutes
  2. The minutes of the July 12 meeting were approved with no changes.

 

  1. Financial Report by Controller  
  2. Cash Balances: John Bernson, Treasurer, reported that the cash balances are in good condition.
  3. Payables: Payables are current. 
  4. Arrears Report: Scot Karr will reach out to the one homeowner who is overdue. Penalties for late payment will be assessed.
  5. Operating revenue and expenses ae on target.
  6. Property Conditions Survey
    - $2.4 million dollars will need to be spent over the next 10 years for upkeep and repairs.
    - Charges to homeowners will be held constant until June 2023 at which time the roofing project will be completed. We should at that time be able to reduce the monthly surcharge. A partial surcharge will be kept in effect for future expenses such as roadways.
    - Money may have to be borrowed for roadways.

 

  1. Unit Owner/ Resident Issues
  2. 2 Alder Way (Sacchetti) Re: Front Stoop
     - Structural work is nearly complete. Final cost to be approximately $6,000 more than estimated. - Increased cost should be offset by the delays in tree work.
  3. Beechwood Lane (Perline) Re: Tree Care
    - Owner is responsible for elective tree

 

  1. Open Items
  2. Tree Removal & Replacement - tree removal to begin next week. Cost is estimated to $30,000.
  3.  Calautti will do replanting. Overall Calautti charges to increase by 3%.
  4. Roadways - repair included in Property Conditions Survey.
  5. Pool Deck- project deferred to a future date.
  6. Deck Replacement - only 7 Beechwood Lane needs replacing.    
  7. Privacy Fences - 8 need replacing for a total cost of $10,000.
  8. Clubhouse - use for outside meetings approved. Repairs to be reviewed.

  1. Approval of Board meeting minutes.
    • The minutes of the May 16, 2022 meeting were approved with no changes.

 

  1. Financial Reports
    • Cash Balances: In good condition.
    • Payables- None currently.
    • Arrears - Nobody is in excess of 31 days.

 

  1. Unit Owner Issues
    •  2 Alder Way (Sacchetti) - Front Stoop. An email from the Homeowner dated June 20, 2022 to FMG is included in the minutes by reference. The main issue appears to be a crack in the foundation of the unit. The soil that the unit sits on will be tested to determine the extent of the excavation needed. Repair of the porch is the responsibility of the HOA. Repair of the unit foundation is the responsibility of the Homeowner.  FMG will determine the next steps.
    • 21 Greenbriar – notice will be given on an improperly parked car.

 

  1. Open Items
    • Clubhouse Refurbishment- Subject will be revisited in the fall in hopes that prices for materials will be lower.
    • Tree Removal & Replacement - Board met with Town Planning Board on June 13 to answer questions. The Board met on site with the Planning Board today before this meeting to show them the situation at hand.
    • Roadways - Arrow Paving estimates that $500,000 will need to be spent on repairs. Project is about a year away. Need to fund in the interim.
    • Deck Replacement - Homeowner at 17 Greenbriar needs to submit an Alteration Agreement for project.

  1. Unit Owner Issues
  2. 2 Alder Way (Sacchetti): Manny’s will do the necessary repairs.

 

  1. Tri-State
  2. According to John Bernson we have a draft report showing the need for repairs is

$3 million over 10 years. John will talk to Tri-State to refine report to reduce cost.

We should have Mario do as many projects as possible in the report to keep costs

down.

 

  1. Year End Financials
  2. Current cash available is $293,000. There are no units in arrears. Scot Karr

observed after review that the financials are in “great shape”.

 

  1. Westchester Tree
  2. Working on permits to take down trees. Will probably start in March. About 125

Trees are to be removed. There is a fair amount of stump removal to be done.   

Trees between driveways may not have to be removed.

 

  1. Painter
  2. 4 more houses to be finished on Birdsall Farm Drive. Ideally would like to paint

only every ten years and do touch up on an hourly basis in between.

 

  1. Clubhouse Renovation
  2. Beata is working on a quote for renovations

1. Financial Report

  • Cash Balances

             -John Bernson, Treasurer, reported that the cash balances are in good condition.

  • Arrears Report

            -There is no unit in arrears.

  • Holiday Bonus

            - The Board awarded a holiday bonus to Mario Rojas, Superintendent, of $1000, pretax.

3. Open Items

  • Garbage Can Cleaning Service

- Residential can cleaning service price list from a local vendor will be provided to Homeowners by FMG.

  • Fall Tree Planting/ Tree Work

- Calautti has done some tree planting. Westchester Tree will provide a bid to remove trees. $40,000 is in the Budget for these projects.

4. HVAC Units at Clubhouse

  • Bids to be finalized.

5. Superintendent Winter Projects

  • Main project is to paint inside of Clubhouse.

6. Generators

  • A list has been compiled. About ten generators have been installed as of now. FMG will review for permission and proper placement.

7. Staining Project

  • Contractors request for a $6000 progress payment was approved. Wood replacement with AZEK will continue.

8. Landscaping

  • Leaf blower equipment will be discussed with Calautti. Composting will be explored. Perennial flowers need to be planted at all street corners. Bushes around electrical boxes that have grown too tall should be trimmed or removed.

9. TRI-STATE

  • Infrastructure study needs to be completed as soon as possible.

  • The Treasurer will inquire of both homeowners.

C. Budget 2022

  • Hereby approved.
  • Will be distributed to homeowners in anticipation of the Annual Meeting, October 7,2021. Noted there is no maintenance increase in the budget.

3. Open Items

 

A. Annual meeting October 7, 2021 at 6:00 PM

  • John Bernson running for re-election. Beata Buhl-Tatka nominated for Board by Nominating Committee.

B. Fall Tree Planting/ Tree Work

  • Targeted trees to be removed. Waiting for estimate from Westchester Tree.

C. Roadway and Speed Bumps

  • Will have Arrow and Tri-State make recommendations.

D. Staining Project

  • Ongoing.

E. Tri-State Proposal

  • General review proposal for $3,500 or a much more detailed report for $8500. Approve for $8,500.

F. Pickle Ball

  • Research whether nets can be placed on wheels to facilitate movement.

6. Caretaker’s Mother

  • Will send written notice of her death and will gift a fruit basket to him from the HOA.

  • 1 owner is significantly behind in maintenance

C. Operating Results

  • Revenues and expenses on target. Should end year on plan

D Budget 2022

  • No surprises. Need a cash flow analysis. Work on budget document to begin next week.

 

3. Open Items

A.  Annual meeting

  • Set for Thursday October 7 at 6:00 PM at the tennis court or by Zoom in the event of inclement weather. FMG will send out notice and proxies.

B. Fall Planting/Tree Work

  • Westchester Tree wants to remove and replace numerous trees. Forty thousand dollars is allotted in the budget for this work.

C. Staining Project

  • Continuing work to avoid wood rot. Work is of good quality and the price I reasonable.

D. Roof Project

  • Roofs should be done by 2023.

E. Roadways/Speed Bumps

  • Will do a survey of homeowner opinions which will be discussed at the Annual Meeting.

F. Halloween Procedures

  • To avoid COVID risk, no door-to-door collection will be permitted. Perhaps candy could be available at the clubhouse with a monitor.

G. Alder Way Pump House

  • Roof replacement has been completed at Town expense.
  • Precision Painting to provide proposal to Town for painting.

H. Pool Heater

  • Obtain a proposal from American Pool. Would not be undertaken before 2023, if at all.

I. Pickle Ball

  • Lines need to be laid down.  Approved for Oval Tennis to make a proposal.

J. Pole Lights

  • Replace current lights with LED fixtures.
  • FMG to research.

K. Landscaper

  • Calautti is doing a good job.

Roofs

  • Roofers finished Birdsall Farm Drive today. Will commence work on Greenbriar Circle late June/early July. Painters to follow roofers.

Pool

  • Pool will open today. A pool notice will be sent out today. New tables, side tables and umbrellas have been ordered.
  • Pool gate from street needs replacing.
  • New basketball rims and poles ordered for tennis courts. Individual rims and poles in driveways must be removed

Flowers and Planting

  • Scott and Calautti will go to nursery and pick out flowers. Focus should be on perennials.

General

  • Date for Annual Meeting and speed bumps to be considered at next Meeting.

Directors present: Scot Karr, Anita Greenwald, Matthew Zwiren, John Bernson and Colin McBride.

Met in person at the clubhouse at 10 AM. Guests present: Robert Ferrara, President of Ferrara Management Group (“FMG”) and Alexis Ferrara Administrative Assistant, FMG.

1. Approval of Board Minutes

  • The minutes of the Board meeting of March 23, 2021 were approved with no changes.

2. Financial Report

  • FMG will research diversifying funds between banks.
  • DJ Tavares Landscaping has provided a report on open items. Report was given to Scot and John for review.

3. Pool Umbrellas

  • Scot and Anita will research umbrellas and stand options.

4. Homeowner Issues

  • Homeowner stated that her front stoop is sinking. She was advised to provide the Board with a written description along with the home inspection report provided at her closing.  The Board will then consult with the Homeowners Association counsel to review the issue.
  • The town architectural review board, the town engineer in the building department are reviewing plans for repair of the deck at this residence.
  • Homeowner has provided proof of insurance to conduct yoga classes at the clubhouse.
  • Homeowner must provide proof of insurance for a tennis instructor if they are to use the tennis court. Homeowners Association must be listed on the insurance as an additional insured.
  • Homeowner must provide the Board with an alteration agreement for the generator that has already been installed.
  • Calautti Landscaping will investigate landscaping and driveway repair issues at the property.

5. Tree Contract

  • Westchester Tree will continue tree pruning and removal.  Will look at stump removal for homeowner.

6. Dogs

  • FMG will send a notice to dog waste violators. Only three “curb your dog” sign should be placed around the complex.

7. Roofs

  • Roofer will start work on Locust Lane and Birdsall Farm Drive soon. The painter will follow the roofer after the roofing is complete.

8. Pool

  • Work on the pool by American Pool has commenced. All permits have been received.
  • Pool reservation system will be instituted.  Aim is to have the pool open by Memorial Day.
  • New security passes will be obtained.

 

The meeting adjourned at 11 AM so an open meeting of the Homeowners Association could be held on the tennis courts.


 

An open meeting of homeowners was held on the tennis courts at 11:05 AM. The following homeowners were in attendance; Sheila Bernson (7 Alder Way), Bernard Trachtenberg (12 Birdsall Farm Drive). Tracey Powell-Rudy (4 Juniper Court), June Wohl (7 Greenbriar Circle) & Sal Mancini (10 Juniper Court).

Discussion ensued about roofing, staining and the pool. Painters will follow the roofers. A notice will be sent to affected homeowners prior to work commencing. Requirements for generator installation were discussed. The open meeting adjourned at 11:45.

The meeting of the Board of Directors reconvened in the clubhouse at 11:47 AM

9. Caretakers Report.

  • Shutters will be painted by our painting contractor no additional cost to the Homeowners Association.
  • Curbs will be repaired by Calautti Landscaping.
  • Downspouts will be replaced as needed by our roofing contractor.
  • Lampposts will be repaired and lights replaced as needed.
  • Tennis courts will be power washed. Weeds on the courts will be sprayed. Oval Tennis will make needed repairs.
  • Speed bumps will be made removable and only two will be installed. 
  • Mario may do work for individuals after 3:00 PM each day.

1. Approval of Board Minutes

  • The minutes of February 17, 2021 were approved with no changes.

2. Tree Contract

  • Tree pruning and removals continue.

3. Staining Project

  • Jim Avery has advised that work will begin the week of April 12th. He will coordinate with the roofer.

4. Pool

  • American Pool will commence work week of April 12th. Mario will provide access to the pool. We are aiming to have the pool open by Memorial Day. FMG will look into new key cards and changing the pool entry code FMG will also review pool monitoring and bathroom cleaning responsibilities with American Pool. FMG will send the Board a draft of the pool monitoring contract.

5. Road Work

  • FMG will review the condition of the roads to see what work needs to be done.

6. Generator

  • This issue will be tabled until September.

7. Homeowner Installed Generator

  • Homeowner must return complete alteration agreement to Board.

8. Insurance for Classes at the Club House

  • FMG will contact broker to see what is required

9. Arrears

  • FMG to contact those individuals who are in arrears about the status on payment

10. DJ Tavares

  • FMG will work with Scot, John, and Sterling Bank to see what invoices are outstanding.

Financial Report by Controller

  • The Controller reviewed the status of the HOA’s bank accounts. Reports will be made monthly.  All at present is an order.
  • Keep Sterling Bank accounts.  McGrath management signatories have been removed from all accounts

Status of Homeowners Fees

Transition of Management Companies

  • Transition from McGrath management to FMG - Robert Ferrara reported that the transition is going well.

Resurfacing of Pools

  • Resurfacing of the main pool in the baby pool.
  • We currently have four bids for the work.
  • In person meetings need to be set up with the bidding companies.  
  • Resurfacing would be a capital improvement, so no sales tax will be incurred.

Tree work

  • We currently have  2 proposals.
  • Dead, dangerous, and common area trees need to be addressed first.

P2P

  • The Controller reviewed this procedure for approval of bills by the Treasurer.

Roofing assessment

  • The roofing assessment is scheduled to end 12/31/2023.    

Superintendent

  • An approved pay increase of $1,000 is to take effect in Mario’s first paycheck for 2021, prorated.
  • Mario is to look into the installation of a small portable generator for the clubhouse so homeowners will have access to electricity in inclement weather.

 

The next meeting will take place on Wednesday, February 17, 2021at 2:00 PM via zoom.

Thursday October 8, 2020

 

Directors Present: Scot Karr, Anita Greenwald, Matthew Zwiren, and Colin McBride met via Zoom at 6:00 PM. Nicholas Forte of McGrath Management joined the meeting. 

The Board confirmed positions and terms on the Board as follows: 

  • Scot Karr, President, term ends 2022 
  • Anita Greenwald, Vice President, term ends 2023
  • Matthew Zwiren, Board Member, term and 2023
  • John Bernson, Treasurer, term in 2021
  • Colin McBride, Secretary, term ends 2021

 

Managing Agent Report 

  • Tennis court needs cracks repaired.  Oval Tennis Company will assess week of October 12, 2020
  • Fall planting proposal was approved. DJ Tavares must remove all debris from plant beds before work can begin.
  • Aquapro will be asked to submit a proposal for pool resurfacing.
  • New pool furniture will be researched.  
  • Mario Rojas continues project of fixing uneven mailboxes and lampposts.
  • Mario has been directed to buy supplies from Home Depot 
  • Perry Verone has agreed to repair all remaining roofs in 2021. Balance owed will be paid in full by 2023 but with no interest. 
  • Landscaping and snow removal proposals will be reviewed.
  • Precision Painting will commence on October 10 correcting work previously done on Greenbriar Circle.

Annual Meeting

Thursday, October 1, 2020

 


A quorum present, the president called the meeting to order at 6:00 pm. Board members in attendance included Scot Karr, Anita Greenwald, Matthew Zwiren and Colin McBride. McGrath Management was represented by Martin Watkins and Nicholas Forte. Association Counsel Lewis Montana was present.

The minutes of the 2019 Annual Meeting were read and approved.

Financial Report
- Martin Watkins reviewed the financial state of the Association.
- Assets and expenses were in line.

Managing Agent Report

Nominating Committee
- The Nominating Committee made its report.
- They nominated Scot Karr, Anita Greenwald, Matthew Zwiren and John Bernson to be in the Board.
- Barry Zungre was nominated from the floor but not seconded.
- Votes were counted by Lewis Montana, Association Counsel.
- Scot Karr, Anita Greenwald, Matthew Zwiren and John Bernson were elected to the Board.

New Business
- Tennis court cracks will be repaired.
- Anita Greenwald welcomed new homeowners, and they introduced themselves to the meeting.
- Installation of a fiber optic line for the complex will be researched.
- Lawns need to be reseeded.

Board of Directors Regular Meeting

Directors Present:  Scot Karr, Anita Greenwald, Matthew Zwiren, and Colin McBride Precision Public Meeting at 6:15

  • In addition to the Board, in attendance were:  John Berenson, Jeffrey Trogone, Alice Ceisler, Anna Orlando, Barbara Holmes, Bernard and Iris Tractenberg, Shoshana Dweck, Howard and Ilene Phillips, Tracy Powell-Rudy, Sal and Julia Mancini, Mindy Unger.

Scot Karr recapped Board activities in recent weeks:
 

Landscaping 

  • The Board has interviewed 5 landscapers.

  • The current landscaper has been put on notice that his performance is not what we expected.  We hope to keep him on to clean up at least until 12/1/20.

  • In anticipation of an early snowfall, we should have another snow removal service in place as soon as possible.

  • The new landscaper should be local to facilitate immediate snow removal. They should not use big machinery on the driveways.  Driveway equipment should have rubber blade covers.

 

Painter

  • Precision Painting has been paid $1.8 million over 15 years for their services.

  • They have not properly replaced wood rot with Azek and they need to correct that situation.

  • We have spent $3,500 per house in wood replacement.

  • Need to increase painting cycles from 3 to 5-8 years.

 

Roofs

  • Roofing costs assessed through 2023.  2021 is the next cycle and 2023 is the next cycle after that.

  • Board has made a proposal to the roofer to do all remaining roofs in 2021, but will pay, without interest, over time, until 2023.

 

Management Companies

  • Doing due diligence in interviewing several management companies.

 

Trees

  • This is the biggest problem facing the homeowners association.

  • Need to take down and trim many, many trees.

 

Generators

  • Homeowners should be aware that Con Ed has a 3-year moratorium on providing gas service which would affect installation of generators.  A dedicated gas line to a generator is now required.

 

HOA Website

  • Anita Greenwald will send out information on the HOA website shortly.

 

Directory

  • An enhanced homeowner directory is being developed.

 

Finances

  • $187,000 is being collected for each painting cycle.

  • If we can stretch cycles to longer than 3 years, we will have money for other projects.

  • Pool needs to be resurfaced.

  • Road will have to resurfaced at some point.

  • Speed bumps need to be reduced in number and size.

  • Speed bumps should be rubber and removable.

 

Driveways

  • Homeowners should coordinate to get a vendor to provide driveway resealing at a good price. Can be talked about on the Facebook Whippoorwill Ridge HOA private group.

 

Voting at the Annual Meeting

  • Those getting the most votes will be elected to the Board.

  • Nominations from the floor will be permitted. Current appointees will serve until the annual meeting which is by NY State non-profit rules.

  • Annual meeting will be by Zoom if there is rain.

 

Committees

  • Homeowner committees for such projects as landscaping, finance, social programs are encouraged.
